Problems in Law Enforcement for Controlling Electronic Cigarettes

Abstract

This research aims to study the background, types, and components of electronic cigarettes, to examine the problems in the enforcement of laws regulating electronic cigarettes, and to propose solutions for improving the enforcement of laws regulating electronic cigarettes.

            The research found that electronic cigarettes were invented by Hon Lik, a Chinese pharmacist, in 2003 (2546 B.E.). They are divided into two types: those without tobacco leaf components and those with tobacco leaf components. The components of electronic cigarettes include a battery, an atomizer, a tank or cartridge, a coil, and a mouthpiece. Thai laws has measures to control e-cigarettes in four areas: regulating imports, regulating sales or services, regulating possession or storage, and prohibiting smoking in smoke-free zones. However, the enforcement of these four control measures may face challenges in aligning with the law's intended purposes.        

            The researcher recommends amending the laws, particularly the Tobacco Products Control Act of 2017 (2560 B.E.), to cover all four aspects: importation, sale or service, possession or custody, and prohibition of smoking in non-smoking areas. Additionally, officials should be granted the authority to enforce the laws, and there should be stringent penalties for officials who neglect to enforce the laws, with harsher punishments than those for the general public.
