Abstract

This article aims to study whether the principle of continuity in providing public services has been enacted into written law. According to the principle of continuity in providing public services, public land transportation services must operate at what times and whether they can be discontinued. Additionally, what rights do citizens have if problems arise in using public land transportation services?

The study found that the principle of continuity in providing public services is a general legal principle that has not been enacted into written law. However, it remains an important principle to consider, as the Administrative Court has applied the principle of continuity in providing public services in its rulings. Therefore, the principle of continuity in providing public services may be applied in other administrative cases as well. Additionally, if a government agency or a private party in a contractual relationship fails to fulfill an administrative contract in providing public services, resulting in an interruption of those services, it is considered a violation of the principle of continuity in providing public services. The general service hours are approximately from 5:00 AM to 10:00 PM, and there are no specific regulations, rules, or laws governing the operation hours of buses or electric trains. Furthermore, if public land transportation service users encounter problems, they have the right to directly report the issues to the relevant authorities. They also have the right to file a lawsuit with the civil court if they suffer bodily harm or life-threatening injuries. However, lawsuits regarding the provision of public services must be filed only in cases where the relevant authorities neglect or delay their duties.

The researcher has the following recommendations: The principle of continuity in providing public services should be established as a strict criterion that the state must adhere to for the benefit of the public. Additionally, the timeframe for providing public land transportation services should be clearly defined. Furthermore, it should be stipulated that citizens who suffer damages should receive appropriate compensation before filing a lawsuit.
