บทคัดย่อ

บทความนี้ช่วยให้เข้าใจอย่างยิ่งขึ้นว่าบริบทของหลักการพื้นฐานว่าด้วยการจำแนกเพศในการแข่งขันกีฬานั้นเกี่ยวข้องสัมพันธ์กับการคุ้มครองความยุติธรรมและการกำกับดูแลตนเองของแต่ละชนิดกีฬาอย่างไรบ้าง ด้วยการศึกษาบริบทที่เชื่อมโยงกันเหล่านี้ บทความนี้ยังศึกษาทบทวนบทบาทของศาลฎีกาสหรัฐอเมริกา ในการปกป้องหลักการพื้นฐานทางกฎหมายขององค์กรบริหารปกครองกีฬา และการควบคุมสกัดกั้นการอาศัยความได้เปรียบทางชีวภาพที่ไม่เป็นธรรม บทความนี้หยิบยกข้อโต้แย้งต่อการห้ามนักกีฬาข้ามเพศเข้าร่วมการแข่งขันกีฬาประเภทหญิงในบริบทของกฎหมายสิทธิมนุษยชนที่ทำหน้าที่เป็นหนึ่งในโครงสร้างอำนาจที่สร้างสังคมขึ้น นอกจากนี้ยังทำความเข้าใจเชิงวิพากษ์เกี่ยวกับแง่มุมสำคัญของการสร้างสมดุลระหว่างความยุติธรรมและการหลอมรวมผู้คนที่มีความหลากหลายเข้าไว้ด้วยกันในวงการกีฬาของสหรัฐอเมริกา รวมไปถึงบริบททางการกีฬาระดับนานาชาติด้วย บทความนี้ยังวิเคราะห์ความเห็นของศาลสหรัฐอเมริกาในคดี Little v.
